The LCCCA voted 4 to 3 early Tuesday morning, June 13, 2006, to SUE Lancaster County, the Lancaster County Commissioners, plus Molly Henderson and Dick Shellenberger in their official capacities. The LCCCA will also seek temporary and permanent injunctions to block any action that would reduce the LCCCA's ability to fund the hotel and convention center project.
This action is specifically in reference to Resolution 36 and Resolution 37, which withdraws any County guarantee for any future borrowing by the LCCCA. However, action against future resolutions were not excluded.
LCCCA Solicitor John Espenshade of Stevens & Lee will NOT be participating in this legal activity, since he also represented Lancaster County for many years. Instead, John Fenningham was appointed special counsel.
In other words, the LCCCA is suing the very same government body that created them in the first place!
Later the same day in a broadcast email, Nevin Cooley announced that the Penn Square Partners, as well as the Redevelopment Authority of the City of Lancaster, are also parties to the lawsuit.
